1. Introduction

Welcome to Celestina Landscaping (“we,” “our,” “us”). These Terms of Service (“Terms”) govern your use of our services and website. By engaging with our services, you agree to comply with and be bound by these Terms.

2. Services

Celestina Landscaping provides a variety of landscaping services including Landscape Design, Custom Gardens, Raised Beds, Sod, Seeding, Landscape Renovation, Mulching, Planting, Fruit Orchards, Berry Patches, Edging, Trimming/Shaping, Drainage, Irrigation, Flower Fertilizing, Masonry, Playground Beds. The specific services to be provided will be detailed in our service agreement on our estimate/invoice sent via docusign/waveapps.

3. Legal Notice

All services provided by Celestina Landscaping LLC are subject to the terms and conditions outlined in our service agreement, which can be found on our estimates/invoices. Payment is due within 15 days from the invoice date unless otherwise agreed upon in writing. Late payments may incur a late fee of 3% per month. If payment is not received within 60 days, Celestina Landscaping LLC reserves the right to suspend services and pursue legal action. All materials and labor provided remain the property of Celestina Landscaping LLC until full payment is received. We offer a 1-year warranty on parts and labor.

4. Plant Life and Tree Warranty

We provide a 1-month warranty on all plant life and trees, effective from the date of purchase, under the condition that they receive daily watering and appropriate care. Please note that if the plants or trees are not adequately cared for, this warranty will not apply, and we will not be responsible for their replacement.

5. Payment Terms and Conditions

To ensure the timely commencement and completion of your project, we require an upfront payment percentage* of the total invoice amount. This initial payment secures your booking and covers the preliminary costs associated with the job. The remaining balance will be due upon completion of the project. *Percentage varies on price of job as well as material cost.

6. Agreement to Estimate

By signing our estimates, the customer acknowledges and agrees to the proposed costs and scope of work outlined herein. This signature authorizes us to commence the specified work as detailed in the estimate.  By signing our estimates or invoices, the customer acknowledges and agrees to our Disclaimer, Terms of Service, and Privacy Policy as outlined on our website.

7. Agreement to Invoice

By signing our invoices, the customer confirms that they approve of and are satisfied with the work provided. This signature signifies acceptance of the completed work and agreement to the terms outlined in the invoice.  By signing our estimates or invoices, the customer acknowledges and agrees to our Disclaimer, Terms of Service, and Privacy Policy as outlined on our website.

• Pest and Disease Management: While we take preventive measures, we cannot guarantee the complete elimination of pests or plant diseases.

Payment and Billing:

• Estimates and Quotes: We provide detailed estimates and quotes before commencing any project. Any changes in scope or additional work will be communicated and approved by the client before proceeding.
• Payment Terms: Payment terms will be outlined in the contract. A deposit may be required before the start of the project, with the balance due upon completion. For ongoing maintenance services, billing will occur on a regular schedule as agreed upon in the contract.
• Cancellation Policy: Clients may cancel services with written notice as specified in the contract. Any work completed up to the cancellation date will be billed accordingly.

11. Licensing and Insurance

Celestina Landscaping LLC is fully licensed and insured to perform landscaping services. Our team is trained and certified to meet all regulatory standards and safety requirements. Our insurance coverage includes general liability, worker’s compensation, disability, commercial auto, and property damage, ensuring that our clients and their properties are protected.

12. Edible Crops Liability

While we take care in selecting and installing edible crops such as vegetables and fruits, Celestina Landscaping LLC is not liable for any illness resulting from the consumption of these crops. It is the client’s responsibility to ensure proper care and maintenance, including appropriate use of fertilizers, pesticides, and watering practices, to avoid contamination or spoilage.

13. Warranty and Liability

Service Warranty: We offer a warranty on our workmanship for a specified period as detailed in the contract. This warranty does not cover damage caused by external factors such as weather, pests, or client negligence.

Liability: Celestina Landscaping LLC is insured and takes all necessary precautions to ensure the safety of our team and clients. However, we are not liable for any damage to property or personal injury that occurs due to circumstances beyond our control.

14. Privacy and Confidentiality

Client Information: We respect our clients’ privacy and ensure that all personal and project-related information is kept confidential and used solely for the purpose of providing our services.

15. Online Store Policies

At Celestina Landscaping, we aim to provide a seamless and satisfying shopping experience. If you are not completely satisfied with your purchase, we offer refunds and exchanges within 30 days of receiving your item(s), provided they are in unused and original condition. Please note that personalized or custom items may not be eligible for refunds.

For any disputes, damaged goods, or issues with your order, please contact our customer support team within 7 days of receiving your order. We will work diligently to resolve the issue, whether through replacement, store credit, or a refund. All refunds will be processed through the original payment method within 5-7 business days of approval. 

16. Media Consent for Project Documentation

By signing our estimates and invoices, the customer agrees to allow Celestina Landscaping LLC to take and use photographs and videos of the completed project for business purposes, including but not limited to showcasing the work on our website, social media accounts, and other promotional materials. This agreement does not grant any rights to the customer for the use of these materials for their own commercial purposes without prior written consent from Celestina Landscaping LLC.
